Recording Audio and the Law
From EZWatch Wiki
The audio recording feature in EZWatch allows you to attach one or more channel(s) of audio to a video channel and record them simultaneously. Although a very useful tool, there are liabilities you may assume if you use this feature incorrectly.
Warning : Automated Video Systems has no control regarding how you may use the audio recording feature. Because of this we assume no liability which may result in the way you use this feature. It is your responsibility to comply with all local, state and federal laws which regulate recording audio conversations.
THE LAW
United States Codes, Title 18, Section 2510 (2) states: Oral communication means any “oral communication” uttered by a person exhibiting an expectation that such communication is not subject to interception under circumstances justifying such expectations. By definition of the code section, a person cannot have an expectation of privacy, nor can he or she expect that communication will not be intercepted, if there are public signs posted, indicating that the communication is being monitored. The First Amendment of the Constitution provides that any conversation between individuals is private, unless otherwise notified. In simple terms, this means that any overhearing or recording of a conversation is illegal…unless both parties are aware that it is being done.
In order to comply with the law, it is your responsibility to clearly post, in plain view, at all entrances and exits where microphones are installed, the following warning: “AUDIO MONITORING IS IN USE ON THESE PREMISES” Remember the postings must be in clear view!
Some state laws may vary, it is further suggested that you consult with your local attorney and become fully aware of the local laws in this regard.
With that said, here's how you record audio with an EZWatch Pro system :
- Setting up Audio Recording on an EZ Watch Pro 4.0 Recording system
- Setting up Audio Recording on an ArmorPro Standalone Recorder
We offer an easy to install audio kit which can be plugged into the audio input jack on all our DVR's. The mic is easily hidden and provides clear recording (with a 30' audio detection radius) which is embedded into the video being recorded for that particular input. Audio Mic Kit
